Do businesses have a duty to provide benefits to employees beyond fair pay and good working conditions?
Do businesses have a duty to provide additional benefits to employees beyond fair pay and good working conditions? Does providing benefits such as child care to some employees discriminate aganist those who do not require such assistance? I'm doing a research paper on this topic and can't find anything- please help!
The first issue is: "What is meant by fair pay?"
The simple definition of "fair pay" would be "an income that allows the employee to live at, or above the local poverty datum line".
Any company in the US, that pays any employee less than thrice the federal minimum wage, fails to pay their employees "a fair pay". [That is the income required for a family of four, to live at the poverty datum line.]
If you mean "Do companies have a legal obligation to provide benefits to employees" that answer is "yes". The obligation extends to what federal, state, or local law requires.
If you mean "Do companies have a moral obligation to provide benefits to employees". The ethical answer is "yes". How much those benefits should be, depends upon how well paid the employee is.
For example, if their pay fails to cover 100% of their health costs, then the company should pay for that coverage, and _not_ deduct it from the individual. If a company touts the state medical insurance program as a "fringe benefit", then the company is acting in an immoral, and unethical manner.
As an aside, I'll point out that companies with good fringe benefit packages, have significantly lower _preventable_ costs, than those that provide either no fringe benefits, or poor fringe benefits. Their non-preventable costs are also lower.
The second issue is what is meant by "good working conditions".
This, unfortunately, can not be objectively defined.
What can be pointed to, is compliance with federal/state/local laws nd regulations regarding work areas, and how they are kept. If a company refuses to allow an employee to go to the emergency room, after an on the job injury, then the company is being both unethical, and illegal. [This was standard procedure at one major company.]
